Khartoum, (SUNA) – The prosecution in the case of plotters of June 1989 coup, in which 34 defendants are being tried on charges of undermining the constitutional order top of them ousted president Omer Hassan Ahmed Al-Bashir and his deputy Ali Osman Mohamed Taha, has offered a promise to one of the accused persons not to carry out the penalty if convicted and to turn him into a king’s witness.
This came in a session of the June 1989 coup plotters court held at the Institute of Legal and Judicial Sciences here today headed by Hon. Hussain Al-Jak Al-Sheikh, Judge of the Supreme Court, where representative of the prosecution Abdul-Qader Al-Badawi, explained that the accused, Hashem Ahmed Omer (Bariqa), had received a promise to transfer him to a king witness in accordance with the provisions of Article (59) of the Code of Criminal Procedure, which requires that he be heard as a prosecution witness.
However, the defense body objected to the prosecution request, where Lawyer Abdel-Basset Sabdarat, said that Article (59) states in the first paragraph that the offer is to be presented to the accused before the trial and that he knows that he will be a king’s witness, while the second paragraph speaks of the accused being presented first as an accused and then becomes a witness.
For his part, the presiding judge decided that the court is to issue a decision in the next session regarding the request.
